Sim Racing is a social activity with inherent risks. I, the undersigned participant, understand that operating a racing simulator (the “activity”) may involve certain risks including: physical discomfort or motion-related side effects (e.g., dizziness or nausea), accidental misuse of equipment resulting in damage, and any other unforeseen risks associated with participation in the simulator. If you feel sick or uncomfortable while using the equipment please stop briefly and ask for assistance. We can make limited adjustments to our equipment to make your session more enjoyable.

There are risks, hazards, and dangers inherent in participating in full-motion simulators, which may include serious injury or property damage. Operating a simulator involves abrupt seat movements and operation of electronics and hydraulic hardware similar to those in actual racing vehicles. Simulators, whether operating or not, may produce loud noises, flashing lights, and unexpected movements at any time without warning. They may not be suitable for persons with epilepsy or underlying physical or mental conditions that are sensitive to such activity.

By voluntarily participating in this activity, I acknowledge and accept these risks, and assume full responsibility for my actions during use of the simulator and agree to use the equipment responsibly and in accordance with written and oral instructions provided by Reality Shift, Inc.

In consideration of being allowed to participate in the activity, I hereby release, waive, and discharge Reality Shift, Inc. and its officers, directors, shareholders, employees, agents, and assigns from any and all liability, claims, or causes of action, whether known or unknown, arising out of or related to: (i) use of the simulator; (ii) personal injury or discomfort sustained during or as a result of my participation in the activity, and (ii) any damage to personal property caused by the activity.

You are being granted a limited, non-exclusive license to use Reality Shift, Inc. equipment and licensed software for the duration of your booked session. The duration of your session is not dependent on your use of the software, including whether you win or lose. We want you to have fun, but if you end your session early, you will still be charged for your entire booked session. If you arrive late to your booked session, you will not receive a refund.

Gambling in relation to this activity is not permitted at any time.

Operating a simulator while intoxicated will decrease the participant's ability to compete and to enjoy the experience. Reality Shift, Inc. may refuse service to visibly intoxicated persons.

Simulated driving involves an element of competition and physical stimulation that can result in elevated emotions and excited behavior. Participants may be exposed to occasional expletives or aggressive competitive behavior, and are expected to quickly and amicably terminate such behavior if requested to do so. Reality Shift, Inc. has a zero-tolerance policy regarding bullying, or sexual or physical abuse (including verbal abuse). If you are found to be violating these rules or any other written or stated rules, your use of the simulator will be terminated and you will not receive a refund.

Reality Shift, Inc. reserves the right to refuse service to any person for any reason if we believe there is a danger to our staff, customers, property, or equipment. Such potential danger includes actual or potential damage, injury, insult, and verbal, physical, or emotional abuse.

Reality Shift Inc welcomes service animals. Service Animals may find the environment of this activity to be unpleasant or distressing. All animals, including service animals, must be under the control of their owner at all times. Reality Shift, Inc. is not able to provide pet-sitting or supervision of service animals.

I agree to indemnify and hold harmless Reality Shift, Inc. from any and all claims, damages, or expenses, including attorney fees, arising from my participation in the activity.

I grant Reality Shift, Inc. permission to use photographs or videos of me participating in the simulator for promotional or marketing purposes.

I read and understand this Waiver and Release of Liability and voluntarily signed below. I understand that I am waiving certain legal rights.

This Agreement shall be interpreted and enforced according to the laws of the state of Oregon. The venue of any suit arising under this Waiver and Release of Liability shall be in any court of competent jurisdiction in Lane County, Oregon.
